Criminal Defense
If you have been accused, arrested or suspected of committing a crime whether it is a minor property crime like vandalism or even a violent crime such as assault or murder, you need someone that will advocate for your rights while representing you in the legal system. You need an advocate that will make sure you are not taken advantage of. You need an advocate with the experience to achieve a desirable outcome no matter what the charges.

CRIMINAL DEFENSE AGAINST FEDERAL CHARGES

According to published statistics, the conviction percentage in federal court is higher than 90%. Therefore it is vital that you are represented by an experienced defense attorney who knows federal law and understands the system. Your defense must be built with care, supported completely by evidence and testimony and must be presented to the court in a professional manner.

CONSPIRACY & DRUG TRAFFICKING
If you have been charged with drug possession or drug trafficking crimes, it is imperative to seek legal counsel immediately. Our legal defense team has successfully handled these crimes many times over and have reached both not guilty verdicts as well as plea bargains that have reduced or eliminated these charges.

A drug charge is highly regulated and subject to a variety of factors including location of arrest, illegal search and seizures, weights and measures and even forensic evidence. Therefore choosing an attorney that has experience with handling drug crimes is imperative.

Crimes involving drugs often include extremely tough guidelines when it comes to penalties and sentencing. Not only can the sentencing affect you but it can also destroy the lives of your loved ones. Without adequate legal counsel, long mandatory prison sentences await those convicted of crimes like possession, selling or trafficking controlled substances. Unfortunately, these types of federal drug charges generally carry harsher punishments and longer sentences.

At the Law Offices of Michael Huff, we are committed to providing our clients with the best legal counsel available. We’ll provide competent legal defense and fair, forthright due process no matter what you’ve been accused of. If you’re interested in learning more about how we can help, contact us today.

FIREARM VIOLATIONS
At the Law Offices of Michael Huff, our legal defense team has successfully built strong defenses against scores of federal firearm violation charges. We have ensured that our clients receive fair and quality representation when dealing with prosecutors, investigators and in the courtroom.

Federal firearms violations are often investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).  Due to the nature of these crimes, the U.S. Attorney’s Office is extremely vigilant about pursuing heavy penalties. Therefore it is of utmost importance to obtain representation from an attorney with the right kind of experience. Because investigators and prosecutors are often eager to resolve these types of crimes, it is also important to retain an attorney who will stand up for your rights and ensure due process.

All offenses are serious, but those that are charged as federal crimes are even more so. With federal sentencing guidelines, a defendant can face extremely harsh penalties that can include mandatory minimum sentences.

Many types of gun charges fall into this category of offenses:

  • Illegal possession of a firearm
  • Illegal sale of a firearm
  • Illegal trafficking of a firearm
  • Illegal altering, destroying or removal of a serial number
  • Possession of a firearm by a convicted felon
  • Possession of an unregistered firearm
  • Straw purchase of a firearm

At the Law Offices of Michael Huff, we are committed to providing the best legal counsel available. We’ll make sure you have a competent, professional legal defense as well as ensuring you receive fair, forthright due process under the law. Please contact us today to learn more and discuss your needs.

HOBBS ACT ROBBERY
If you have been charged with a state crime that could be considered wire fraud, mail fraud, robbery, extortion or money laundering, it is possible that in addition to the state charges you face, you may also be prosecuted under a federal statute called the Hobbs Act Robbery Statute, or 18 U.S.C. § 1951. Attorney Michael Huff has represented many clients in these types of cases and knows how to navigate this very complicated set of federal charges.

The Hobbs Act criminalizes both robbery and extortion, where:

  • Robbery means the unlawful taking or obtaining of personal property from the person or in the presence of another, against his will
  • Extortion means the obtaining of property from another, with his consent, induced by wrongful use of actual or threatened force, violence, or fear, or under color of official right.

The Hobbs Act allows the Federal Government to have jurisdiction over Robbery’s that effect interstate commerce, which is quite often when money is involved. Often times the case will begin in State Court but will later be picked up by the Federal Government and be transferred to Federal Court in your jurisdiction.

While originally used to combat racketeering in labor-management disputes, the Hobbs Act is often used in connection with cases of public corruption.

If you are facing charges that could be persecuted using the Hobbs Act, it is very important that you receive representation by an experienced federal legal defense attorney.

At the Law Offices of Michael Huff, we are committed to providing the best legal counsel available. We’ll make sure you have a competent, professional legal defense as well as ensuring you receive fair, forthright due process under the law. A federal murder charge is one of the most serious charges you can face. If you are charged in federal court with murder, you need to consult with an experienced criminal defense lawyer immediately.

In most cases, murder is a state crime that is handled in state court and under state laws. However, depending on the circumstances, murder charges may be brought under federal law. If you are found guilty, you could be sentenced to life in federal prison or even face the death penalty.

Federal murder charges may arise from a number of circumstances, including:

  • Murder of a federal official
  • A retaliatory murder committed against the family members of a federal official
  • Murder committed after escaping from a federal prison
  • A civil rights offense involving murder
  • Murder committed as part of a drive-by shooting related to drugs
  • Murder that occurred at an airport or on an airplane
  • Murder committed during a kidnapping or involving hostages

These specific acts are drawn from a list of 35 crimes, both state and federal. If the crimes are related to the operation of a criminal enterprise, you can be charged under RICO statutes.

RICO charges include:

DRUG POSSESSION & DRUG DISTRIBUTION
If you’ve been charged with drug possession, drug distribution or any type of drug-related crime, it is important to seek legal guidance immediately. Our legal defense team has successfully handled state drug charges many times over and have achieved scores of successful outcomes.

Crimes involving drugs have extremely tough guidelines when it comes to penalties and sentencing. Not only can the sentencing affect you, but it can also destroy the lives of your loved ones. Often without adequate legal counseling, long mandatory prison sentences await for those convicted of crimes like possession, selling or trafficking controlled substances.

State arrests for simple possession tend to be charged as misdemeanors and usually involve probation, a short term in a local jail or a fine. However, this can depend on the criminal history and age of the person being charged. In addition, many drug arrests include additional charges that must be considered and defended.

At the Law Offices of Michael Huff, we are committed to providing our clients with the best legal counsel available. We believe each individual has the right to competent legal defense and fair, forthright due process no matter what the charges. If you’ve been accused of drug possession or trafficking, please contact us today. We’ll discuss your case and determine how our team can help.

SEX CRIMES
When facing sex crime charges you need an aggressive, knowledgeable criminal defense attorney who will stand up for your rights. We have successfully represented clients in the Commonwealth of Pennsylvania and the states of New York and New Jersey who have been accused of these types of offenses.

In choosing a legal defense counsel, you can count on our firm’s dedication through every step of your case from initial contact with investigators through to the courtroom and beyond. Thanks to extensive experience in dealing with a variety of state charges, our legal defense team understands the state court system is ready to provide the legal counsel you deserve.

A number of different offenses fall into the sex crimes category, but they generally involve illegal or coerced sexual conduct against another individual. Every state has laws prohibiting acts of rape and sexual assault. In addition, each state has its own statue of limitations that defines the time frame during which a victim may file a lawsuit.

An added layer of complexity arising from these types of charges is that individuals convicted of sex crimes, regardless of severity, can be considered “sex offenders” and may face having their names added to state and federal sex offender registries. Because these types of accusations and convictions can follow you for years to come, a strong defense is imperative.

Examples of state sex crimes we handle include:

  • Rape
  • Statutory Sexual Assault
  • Involuntary Deviant Sexual Intercourse

Sex crimes are taken very seriously in state courts and carry tough penalties with many including mandatory minimum sentences. This makes securing an attorney who understands the individual state or commonwealth sentencing guidelines critical to building a strong defense.

At the Law Offices of Michael Huff, we are committed to providing our clients with the best legal counsel available. We believe everyone has the right to competent legal defense as well as fair, forthright due process under the law. THEFT CRIMES

Theft crimes can include such offenses as robbery, burglary, auto theft, identity theft, shoplifting, larceny and check or credit card fraud. Being found guilty of such crimes could result in jail time, fines, restitution, community service and probation.

Penalties for property and theft offenses often depend on the value of the property allegedly destroyed or stolen. Sometimes penalties can be based on circumstances that might exist during the alleged theft or property crime. In some cases, these types of convictions could mean up to decades of jail time. Additionally, a theft or property crime on your record could affect your ability to find gainful employment in the future. This makes it important to contest your charges and present a strong defense.

  • Receiving Stolen Property
  • Forgery

At the Law Offices of Michael Huff, we are committed to providing you with the best legal counsel available no matter what you’re accused of. HOMICIDE DEFENSE
A murder charge is perhaps the most serious charge you could face. If you are accused of or charged with any type of manslaughter or murder, you need to consult with a criminal defense lawyer immediately.

In most cases, murder is a state crime that is handled in state court and under state laws. Often, state law defines sentencing guidelines for charges including first-degree murder, second-degree murder, manslaughter and others. However, in many states the jury can make their own sentencing recommendation. The judge can then choose to accept the jury’s recommendation or levy an altogether different sentence.

From state to state maximum penalties can differ greatly. Capital punishment, or the death penalty, was abolished by New Jersey in 2007 with New York following suit in 2009. The maximum penalty for first-degree murder in these states is life without the possibility of parole. In Pennsylvania, however, the death penalty is still an option in sentencing under certain circumstances.

If you face a state murder charge in PA, NJ or NY, you will need an experienced criminal defense lawyer who not only has represented clients in these various state courts but who also has experience with murder cases. In addition to our legal defense team, we also have access to independent experts in forensics, psychology and other disciplines. These experts can be called in to provide an independent review of the state’s evidence and can effectively challenge discrepancies or oversights within the prosecution’s case.

State murder charges could include:

  • First-degree Murder
  • Second-degree Murder
  • Third-degree Murder
  • Voluntary Manslaughter
  • Involuntary Manslaughter

At the Law Offices of Michael Huff, you can count on our team’s dedicated representation through every step of your case, from the moment of initial accusation and on into the courtroom. With extensive experience in dealing with the most serious of charges, our firm is ready to provide the legal counsel that you deserve. Contact us today to discuss your needs and learn more about how we can help.
